Law in a nutshell
If you are a Joint Tenant with someone and you pass away, your share of the property passes to the other party by survivorship. If you are a Tenant in Common with someone, your share of the property must either be left in a Will or if there is no Will your share will be governed by the Rules of Intestacy.
