Law in a nutshell
The trustee’s role is fiduciary so, at common law, trustees are not to be paid for acting as such. Alongside the many lay trustees, there are professional trustees who are able to bring their expertise to add valuable benefits to trusts and estates. Recognising this reality, the law permits professional trustees to be remunerated in certain circumstances.
