nyone appointing attorneys under a Lasting Power of Attorney (LPA) must have the required mental capacity to do so. While important safeguards exist to protect the donor before an LPA is executed, genuine concerns that they did not in fact have capacity could arise further down the line. The attorneys could then find themselves in a difficult legal position.
